Overview
The E-2 Treaty Investor visa allows nationals of treaty countries to enter and work in the United States based on a substantial investment in a U.S. business. The investor must be coming to the U.S. to develop and direct the business enterprise.
Unlike the EB-5 immigrant investor visa, the E-2 is a non-immigrant visa with no minimum investment amount. However, the investment must be "substantial" relative to the total cost of the business and sufficient to ensure the investor's commitment to the success of the enterprise. Generally, investments of $100,000 or more are considered substantial for most businesses.
The E-2 visa is renewable indefinitely as long as the business remains operational and the investor continues to direct it. The visa also allows the investor to bring key employees from the same treaty country. E-2 spouses receive automatic work authorization in the U.S.
