The E-1 Treaty Trader visa allows nationals of treaty countries to enter the United States to engage in substantial trade principally between the U.S. and the treaty country. Trade includes exchange of goods, services, banking, insurance, transportation, communications, and data processing.

To qualify, the applicant must be a national of a treaty country, the trading firm must have the nationality of the treaty country, the trade must be substantial (numerous transactions over time, not necessarily high dollar value), and more than 50% of the trade must be between the U.S. and the treaty country.

E-1 visas are issued in increments up to 5 years and can be renewed indefinitely as long as the trading activity continues. The visa allows the trader to bring key employees who are also nationals of the treaty country. E-1 spouses receive work authorization in the U.S.

Trade includes: exchange of goods (physical merchandise), services, banking, insurance, transportation, tourism, communications, and technology transfer. Trade in services and technology has become increasingly recognized. The key is international exchange of items of value.

Substantial trade means continuous flow of considerable trade items involving numerous transactions over time. There's no minimum dollar amount, but trade should be significant enough to support the trader. Volume and frequency matter more than single large transactions.

E-1 is for traders (buying/selling goods or services between countries). E-2 is for investors (investing capital in a U.S. business). Different activities, different requirements. A company could potentially qualify for both if it trades AND the owner invested substantially.

Yes, E-1 dependent spouses receive work authorization and can apply for an Employment Authorization Document (EAD) after arrival. They can work for any employer in any field—not restricted to the treaty business.

E-1 is a non-immigrant visa without a direct path to a green card. However, you can pursue a green card through other means (employer sponsorship, extraordinary ability, etc.) while maintaining E-1 status. Many E-1 holders renew indefinitely.
