The O-1 visa is for individuals with extraordinary ability or achievement in sciences, arts, education, business, athletics, or the motion picture/television industry. It requires demonstrating that you have risen to the very top of your field through sustained national or international acclaim.

For O-1A (sciences, education, business, or athletics), applicants must show extraordinary ability through documentation such as major awards, published material about them, original contributions of major significance, high salary, or other comparable evidence. For O-1B (arts, motion picture, or television), the standard is distinction rather than extraordinary ability.

The O-1 visa is employer-sponsored but offers significant flexibility. There are no annual caps, no lottery, and it can be renewed indefinitely in up to 3-year increments. O-1 holders can also self-sponsor through an agent. The standard is demanding but achievable for accomplished professionals.

You must meet at least 3 of 8 criteria including: major awards, association membership, published material about you, judging others' work, original contributions, scholarly articles, high salary, or leading roles. A single major award like a Nobel Prize can also qualify you automatically.

O-1A is for sciences, education, business, and athletics, requiring 'extraordinary ability.' O-1B is for arts and entertainment, requiring 'distinction' (a somewhat lower standard). O-1B for film/TV has different specific criteria focused on industry recognition.

You cannot directly self-petition, but you can use an agent as your sponsor if you work with multiple employers or as a freelancer. The agent can be your own company, a talent agency, or any entity authorized to act on your behalf.

O-1 has advantages: no annual cap, no lottery, longer validity (3 years vs. 3 years initial), and no 6-year limit. However, O-1 has a higher evidentiary standard. For highly accomplished individuals, O-1 is often preferable. It also provides a path to the EB-1A green card.

No, O-3 dependent spouses cannot work in the United States. They can study but are not authorized for employment. If your spouse wants to work, they would need to obtain their own work visa or qualify for O-1 themselves.
